{"id":7638,"date":"2026-09-18T17:21:18","date_gmt":"2026-09-18T22:21:18","guid":{"rendered":"https:\/\/godoy.legal\/decreto-legislativo-1417-de-2026\/"},"modified":"2026-09-18T17:32:08","modified_gmt":"2026-09-18T22:32:08","slug":"decreto-legislativo-1417-de-2026","status":"publish","type":"post","link":"https:\/\/godoy.legal\/en\/decreto-legislativo-1417-de-2026\/","title":{"rendered":"Decreto Legislativo 1417 de 2026"},"content":{"rendered":"\n<p>El 17 de septiembre de 2026, con vigencia inmediata, se public\u00f3 el presente decreto, mediante el cual el Ministerio del Trabajo adopta medidas extraordinarias y temporales para proteger el empleo y los ingresos de los trabajadores damnificados por el sismo del 10 de agosto de 2026, a trav\u00e9s de tres mecanismos complementarios: apoyo estatal al pago de n\u00f3mina para micro y peque\u00f1as empresas; protecci\u00f3n econ\u00f3mica para trabajadores cesantes damnificados; y medidas laborales extraordinarias para la protecci\u00f3n del empleo.<\/p>\n\n\n\n<p>A continuaci\u00f3n, destacamos los aspectos m\u00e1s relevantes:<\/p>\n\n\n\n<p><strong>1.<\/strong> <strong>Apoyo al pago de n\u00f3mina.<\/strong> A trav\u00e9s de un aporte estatal con recursos del Fondo Milagro (Decreto 1379 de 2026), las micro y peque\u00f1as empresas (hasta 50 trabajadores) y personas naturales empleadoras \u2014constituidas antes del 10 de agosto de 2026 y al d\u00eda en aportes PILA a julio de 2026\u2014 podr\u00e1n acceder a un aporte estatal equivalente al 40% de un SMLMV ($700.362) por cada trabajador damnificado elegible, esto es, aquel inscrito en el RUD, con salario entre 1 y 2 SMLMV y v\u00ednculo laboral vigente. El beneficio opera por hasta 6 ciclos mensuales con postulaci\u00f3n independiente por ciclo y no sustituye las obligaciones salariales, prestacionales ni de seguridad social a cargo del empleador.<\/p>\n\n\n\n<p><strong>\u00bfQui\u00e9nes se entender\u00e1n por damnificados? <\/strong>Aquellas personas que sufrieron afectaciones directas por el terremoto y que han sido registradas oficialmente como tales ante la UNGRD o en el mecanismo oficial equivalente que esta entidad defina, en el Registro \u00danico de Damnificados (RUD).<\/p>\n\n\n\n<p><strong>2.<\/strong> <strong>Protecci\u00f3n econ\u00f3mica para cesantes damnificados.<\/strong> Consiste en transferencias a trabajadores dependientes e independientes cesantes, con posibilidad de reconocimiento hasta el 31 de diciembre de 2026, con el fin de mitigar la vulnerabilidad derivada de la p\u00e9rdida de ingresos.<\/p>\n\n\n\n<p><strong>3. Medidas laborales extraordinarias.<\/strong> El decreto establece: elretiro parcial de cesant\u00edas por el trabajador damnificado con contrato suspendido, con autorizaci\u00f3ndelempleador, hasta porlossalarios dejados de percibir; y la reducci\u00f3n de 15 d\u00edas a 1 d\u00eda calendario del aviso previo para conceder o solicitar vacaciones cuando empleador o trabajador est\u00e9n afectados por el sismo, sin que ello implique desmejora laboral.<\/p>\n\n\n\n<p><strong><a href=\"https:\/\/godoy.legal\/en\/incentivos-tributarios-para-nuevas-inversiones-privadas-en-las-zonas-afectadas-por-el-terremoto\/\" data-type=\"link\" data-id=\"https:\/\/godoy.legal\/incentivos-tributarios-para-nuevas-inversiones-privadas-en-las-zonas-afectadas-por-el-terremoto\/\"><mark style=\"background-color:rgba(0, 0, 0, 0);color:#002723\" class=\"has-inline-color\">Tambi\u00e9n puede leer: Incentivos tributarios para nuevas inversiones privadas en las zonas afectadas por el terremoto<\/mark><\/a><\/strong><\/p>\n\n\n\n<p><strong>4.<\/strong> <strong>Implicaciones.<\/strong> Las medidas no constituyen autorizaci\u00f3n para reducir unilateralmente salarios, desconocer derechos ciertos e indiscutibles de los trabajadores, la libertad sindical, la negociaci\u00f3n colectiva ni las obligaciones de seguridad social y salud en el trabajo. Si una disposici\u00f3n normativa \u2014convenci\u00f3n colectiva, pacto colectivo, laudo arbitral o contrato individual\u2014 contiene condiciones m\u00e1s favorables, esta prevalecer\u00e1 sobre el presente decreto.<\/p>\n\n\n\n<p><strong>5. Vigencia.<\/strong> Ser\u00e1 de 6 meses contados desde la publicaci\u00f3n del decreto para lo previsto en los art\u00edculos 43, 44 y 45, siempre que subsistan las circunstancias derivadas del sismo. Tras el Estado de Emergencia, la continuidad de estas medidas queda condicionada a certificaci\u00f3n motivada del Ministerio del Trabajo.<\/p>\n\n\n\n<p><strong>6.<\/strong> <strong>Suspensiones de contratos y t\u00e9rminos administrativos.<\/strong> Se habilita un tr\u00e1mite preferente que reduce de 2 meses a 15 d\u00edas h\u00e1biles el plazo para decidir solicitudes de suspensi\u00f3n vinculadas al sismo, sin silencio administrativo positivo. El Ministerio podr\u00e1 suspender, por hasta 2 meses, los plazos de actuaciones sancionatorias y dem\u00e1s tr\u00e1mites en municipios afectados, salvo los relativos a riesgo grave para la vida, trabajo infantil, acoso laboral, discriminaci\u00f3n, libertad sindical o mora en aportes a seguridad social.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>El 17 de septiembre de 2026, con
